Welcome to EarthSmart Medical Resource, LLC ("EarthSmart Medical Resource, LLC” “EarthSmart Medical Resource,” “EarthSmart,” "we," "us," or "our"). These Terms & Conditions ("Terms") apply to your access to and use of our website and services. By visiting our site or interacting with our staff, you accept these Terms in their entirety.
1. Who We Are
EarthSmart Medical Resource is a small business dedicated to making a difference in sustainability and environmental responsibility within healthcare and education. We strive to reduce the monumental excess of expired and non-expired manufactured medical products going into landfills, and to provide an easy-to-use, customer-service-oriented platform for institutions of all levels of health care and medical education to procure supplies for instruction, simulation, and research and development.
2. Limitations & Disclaimer
EarthSmart Medical Resource is a reseller of expired and non-expired medical disposables and related equipment for non-clinical and non-human use for educational, simulation training, research and development, and veterinary purposes. It is the sole responsibility of the buyer to judge the safety of a given product and to determine the compatibility of any item(s) for a particular application. By purchasing and using this product in any manner, you agree to the following terms: Buyer assumes all risk of liability with respect to the purchase of the item(s). The seller makes no claims regarding the sterility of any item. By purchasing any product from EarthSmart Medical Resource, LLC, the buyer agrees that the seller shall not be held liable for damage, injury, or any other loss that may occur from the purchase or use of any product in any way. There are no warranties, expressed or implied, as to the suitability of these products for any given use. Buyer and/or any third party agree to hold harmless the seller and all associated persons and companies in any event of accident, injury, damage, or loss that may arise, under any circumstance, from the purchase and/or use of said products.
Most inventory, whether expired or not, is in the manufacturer's original packaging, unless otherwise noted in the product description. Most of the expired and non-expired devices are in the original boxes. Some items are outside their original boxes, but they are still in their sealed inner packaging. EarthSmart Medical Resource cannot test for the sterility or functionality of any device. There is no valid manufacturer warranty on the products that EarthSmart Medical Resource sells. Any services provided by the original manufacturer of the products are not available.
3. Customer Service Pledge
Our goal is 100% customer satisfaction every day. As a small business, we take pride in our ability to provide personalized customer service. We strive to accommodate urgent and overnight shipping requests whenever possible. In the event of circumstances beyond our control, we cannot guarantee or refund shipping costs if a courier fails to meet their delivery deadline. However, we will do everything possible to ensure timely delivery.
4. Return Policy
In the unlikely event that you are not satisfied with your purchase, please contact our office by calling 470-493-2910 or emailing CustomerService@EarthSmartMedical.com to let us know. We will do everything possible to rectify the situation or provide a full refund upon return of your product(s) within 30 days.
5. Ordering Online
Place your order on our website by adding items to your cart and paying via PayPal, any major credit card, Apple Pay, Link, Klarna, and other similar payment methods. Most items online are stored in-house and are in stock. In the rare event an item is online but no longer in stock, we will contact you within 24-48 hours to advise you of a possible substitute product, or to issue a refund. Typically, your order will ship within 1-3 business days from the date of order.
6. Ordering via Requisitions & Purchase Orders
Email a description, list, or screenshot of your desired items, along with your organization's name, shipping address, and phone number, to Orders@EarthSmartMedical.com.
We will email you a quote (including applicable shipping charges and taxes) within 48 hours. Tip: Add items to the online cart to generate a list and check availability. You can then screenshot this list and email it to us for faster processing, then remove the items from the cart.
If your institution is tax-exempt, please attach your Sales Tax Certificate of Exemption.
Once we receive the purchase order from your institution, standard processing takes 2–3 business days. You will then receive a confirmation email with the courier's tracking number.
Payment terms are Net 30 Days. A late fee of 1.5% per month is applied to all past-due accounts that remain unpaid after 30 days.
